               referred to the Committee on the Judiciary

                                 A BILL

 To improve the United States Marshals Service, and for other purposes.

    Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the ``United States Marshals Service
Improvement Act of 1995''.

SEC. 2. PHASING OUT OF POLITICAL APPOINTEES.

    Any individual who, on the date of the enactment of this Act, is a
United States marshal to whose appointment the Senate has given its
advice and consent, shall continue to serve for the remainder of the
term for which such marshal was appointed, unless removed at an earlier
date by the President.

SEC. 3. APPOINTMENT OF UNITED STATES MARSHALS.

    Section 561 of title 28, United States Code, is amended--
            (1) in subsection (c)--
                    (A) by striking ``The President shall appoint, by
                and with the advice and consent of the Senate,'' and
                inserting ``The Attorney General shall appoint''; and
                    (B) by inserting ``from a position in the
                competitive service in the United States Marshals
                Service,'' after ``District of Columbia,''; and
            (2) in subsection (d), by striking ``President'' and
        inserting ``Attorney General''.

SEC. 4. CONFORMING AMENDMENTS.

    (a) Repeal.--Section 562 of title 28, United States Code, and the
item relating to such section in the table of sections at the beginning
of chapter 37 of such title, are repealed.
    (b) Technical Amendments.--Section 569 of title 28, United States
Code, is amended--
            (1) by striking ``(a)''; and
            (2) by striking subsection (b).
