IN THE SENATE OF THE UNITED STATES January 14 (legislative day, JANUARY 3), 1991 Mr. MOYNIHAN introduced the following bill; which was read twice and referred to the Committee on the Judiciary A BILL To direct the payment of claims against the United States arising out of damage caused to the vessel `Iver Chaser' arising out of the mining of the territorial waters of Nicaragua. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That (a) the Secretary of the Treasury shall pay, out of any money in the Treasury not otherwise appropriated, such amounts to such persons as may be certified by the Secretary of State in accordance with subsection (b). (b)(1) Any person having a claim against the United States for damage to the vessel `Iver Chaser' as the result of the explosion on March 28, 1984, of a mine or other device placed in the territorial waters of Nicaragua with the assistance, directly or indirectly, of the United States Government may file a claim for damages with the Secretary of State. Except as provided in paragraph (2), the Secretary of State shall review such claims and shall, upon the determination that a claim is strictly proved and verified, certify the identity of the claimant and the amount of the claim to the Secretary of the Treasury. (2) The Secretary of State shall not certify under paragraph (1) any claim for damages if he determines that the vessel `Iver Chaser' was used for military or security operations by the Sandinista government of Nicaragua, including operations to transport arms or other support to Nicaragua or the rebels in El Salvador. (c) For purposes of this section, the term `person' means-- (1) any natural person; and (2) any corporation, partnership, or other juridical entity. </pre>
